Everyone’s reading this as a PBM rule. Read it again. Here’s what’s getting skipped. The ERISA 408(b)(2) disclosure obligation already expanded to TPAs and PBMs on February 3, 2026 under CAA-26. That’s been live for nine months. The DOL just finalized its PBM fee disclosure rule, and most of the coverage leads with the July 1, 2027 date and the PBM obligations for large self funded plans. What the final rule adds is specificity. It gives an example of what a good faith TPA disclosure looks like, and the list is longer than most TPAs have been providing: Administrative and per employee per month fees 340B related income Provider and network compensation Affiliate, subcontractor, and vertically integrated compensation Data monetization compensation Payment and recovery compensation There’s enforcement relief running through plan years beginning on or after July 1, 2027. It covers service providers who made disclosures under a good faith interpretation. Doing nothing isn’t a good faith interpretation. If you have self funded clients, ask what their TPA has disclosed. “Nothing yet” is an answer worth knowing before renewal. #BCS #PBM #SelfFunded #ERISA

You win the account in October. You find out what you bought in February. The BOR gets signed. The incumbent hands over a file. Everyone congratulates the producer. Then the questions start. The wrap document hasn’t been updated since 2019. Nobody can find a Section 125 plan document at all. There’s a tobacco surcharge running through payroll and no one knows where the money goes. None of that was in the finalist meeting. All of it is yours now. This is exactly the kind of thing BCS helps agencies get ahead of. We work with your team to review what you inherited, so the problems surface on your timeline instead of the client’s. If you’re onboarding new groups this quarter, let’s talk. Better to know in November than in February. #employeebenefits #benefitsbrokers #benefitscompliance #accountmanagement

The first 90 days decide whether you keep the account. Winning the account was the easy part. The employer signed because of what you said you'd do, and now they're watching to see if it happens. Compliance is where that gets tested early. Something will come up in the first quarter, usually a question the last broker never answered well, and how you handle it sets the tone for the whole relationship. They remember the first real answer they got from you. Get that one right and the renewal conversation eleven months later is basically already over. Get it wrong and you spend the year explaining. This is one of the many perks of our Compliance Advisory Program. Your team sends us a scenario, gets a clear answer with the supporting detail in 24 to 48 hours, and walks the client through it themselves. The pitch got you in. The first 90 days decide how long you stay. #BCS #BenefitsCompliance #EmployeeBenefits #ClientOnboarding

Auto renewing medical plans still owe an SBC, 30 days out. If a client's plan renews with no written application, on paper or in a portal, there's no enrollment moment to staple the SBC to. The requirement doesn't disappear along with the packet. The rule sets it at 30 days before the first day of the new plan or policy year. For a January 1 plan, that's December 2. One catch for fully insured groups. If the carrier hasn't issued or renewed the policy by that mark, the deadline moves to 7 business days after the policy is issued or written confirmation of intent to renew arrives, whichever comes first. That second trigger can land well before December 2. Worth flagging which groups auto renew, then confirming the carrier is actually issuing on time. #BCS #EmployeeBenefits #BenefitsCompliance #SBC

In a first meeting, finding a problem beats making a promise every time Your prospect has heard the same pitch from three other agencies this quarter. Great service, fast response times, a dedicated team. It all blurs together by the third meeting. Show up having actually looked at their plan, with one specific thing you found, and you're the only person in the room who did real work before the meeting started. You don't have to say a word about their current broker. The finding speaks for itself and the prospect draws their own conclusion about who's been paying attention. That's the moment the conversation stops being about who they like and starts being about who knows their plan. #BCS #BenefitsCompliance #EmployeeBenefits #NewBusiness

Your producers already know how to build trust and close deals. Give them real compliance depth to back that up, and watch what happens to the pace of the conversation. When a producer can speak to a prospect's actual plan risk in specific terms, prospects lean in instead of politely wrapping up the meeting. The relationship skills were already there. The depth just gives them somewhere to point. That's the edge that turns a good producer into the one prospects choose, even when three other agencies with strong teams of their own are pitching essentially the exact same thing to the same employer, on the same afternoon. #BCS #BenefitsCompliance #EmployeeBenefits #SalesEnablement
