A growing number of companies are following Costco's lead by filing protective lawsuits in the U.S. Court of International Trade to preserve their right to refunds if the Supreme Court strikes down the Trump administration's tariffs. If your company paid tariffs in 2025 imposed under the International Emergency Economic Powers Act, you should consider immediate steps to protect your position. Our International Trade team is filing suit on behalf of a coalition of plaintiffs. Learn more in this alert by Lizbeth Levinson and Brittney Powell.

The Department of Defense has launched one of the largest procurements in U.S. history: the Scalable Homeland Innovative Enterprise Layered Defense (SHIELD) initiative. With over 1,000 initial awards and a flexible contract structure, SHIELD opens the door for qualified companies to compete to provide aspects of the defense system. On the blog, Fox Federal Government Contracts & Procurement Partners Evan Williams and Luke Levasseur explore the critical issues that companies interested in competing for future SHIELD work—either as a prime, subcontractor or team member—should consider. 💡Read on: https://lnkd.in/eSDcZYT5 #FedCon #GovCon #DoD #GoldenDome

Trade agreements with enforceable workers’ rights requirements are trending in the Trump Administration's foreign policy. First the USMCA in our backyard, and now agreements with countries in China’s. On Sunday, the White House announced reciprocal trade agreements with Cambodia and Malaysia and frameworks for potentially similar agreements with Thailand and Vietnam. The labor requirements are novel. There's more in my article ( 👇 ), but here are some key labor changes on the horizon in Cambodia and Malaysia. Companies with operations or supply chains in these countries should prepare. ➡️Cambodia and Malaysia must protect internationally recognized labor rights and ban the import of goods produced by forced labor. Several rights are spelled out in detail. ➡️Notably, for example, Cambodia must engage in apparently ILO-style “tripartite” consultations -- with government, employer and worker representatives -- to strengthen union rights. ➡️The Malaysia agreement focuses heavily on labor protections for migrant workers, such as requiring Malaysia to prohibit employers from charging those workers recruitment fees and increasing transparency around migrant worker quota systems. ➡️The enforcement provisions in both agreements are novel. If the United States considers that these countries have not complied with their new labor commitments, it may take action “in accordance with applicable domestic law.” This could permit the United States to unilaterally impose tariffs. https://lnkd.in/eShMBR_V

Recorded at our 2025 White-Collar Symposium earlier this month, this special episode gives guests Rachel Barkow and Casey Michel an opportunity to address the issues explored in each other’s books. With host Matthew S. Adams as moderator, Rachel — an author, law professor and former clerk for Justice Antonin Scalia — and Casey — an investigative journalist and Director of the Combating Kleptocracy Program at the Human Rights Foundation (HRF) — explore the common themes in criminal law that connect their works. Rachel and Casey dig into how constitutional rights, judicial interpretation of those rights and legislative statutes influence both mass incarceration and foreign lobbying. Their conversation weaves together turning points and pivotal figures in U.S. history — Richard Nixon and Bob Dole, the Gilded Age and the 1960s — and identifies how those moments and individuals have shaped today’s realities.
