The latest IP dispute making headlines? A clash between Chelsea Football Club star Cole Palmer and prestigious Bordeaux winery Château Palmer over the trademark "Cold Palmer." ⚽ Palmer, known for his icy goal celebration and rising stardom, filed to trademark “Cold Palmer” for a wide range of products, including clothing, drinks, and wine. 🍷 That last category caught the attention of Château Palmer, a historic estate founded in 1814, prompting them to formally oppose the application. Their concern? Consumer confusion and brand dilution, especially in the wine category. 💡 This case raises a few key questions: - Can athlete personas be protected across luxury categories like wine? - How far can personal branding extend before clashing with legacy trademarks? - Are motion marks (like goal celebrations) the next frontier in trademark law? 📌 The case now in the hands of the UKIPO; may set a precedent for how courts balance the rise of celebrity-led brand empires with long-standing commercial rights in legacy industries. 👀 Whether you’re team athlete or team vineyard, one thing is clear: the line between personal branding and protected trademarks is blurrier than ever. #TrademarkLaw #AthleteBranding #IPStrategy #BrandProtection #LegalTech #ColePalmer #ChâteauPalmer #MotionMarks #CelebrityBrands #SportsAndIP #Digip #CaseStudy #TrademarkManagement

👜 Do Trademarks Apply to NFTs? The High-Stakes Legal Battle Between Hermès and Mason Rothschild The legal battle between Hermès and Mason Rothschild over the MetaBirkins NFT collection has reached the U.S. Court of Appeals for the Second Circuit, with major implications for how trademark law applies to digital assets. Rothschild is challenging the verdict that found him liable for trademark infringement over his use of the Birkin name and likeness in NFTs. This case raises critical questions for brands and digital creators: - Do trademarks extend to virtual goods and NFTs, or are they protected under artistic expression? - Should brands have the same enforcement power in the metaverse as they do in the physical world? - How will IP law evolve to balance creative freedom with brand protection in digital spaces? The stakes are high. Hermès secured a permanent injunction, blocking Rothschild from using the Birkin marks and requiring him to pay $133,000 in damages while transferring the MetaBirkins.com domain. Rothschild argues that NFTs should be considered artistic expression, not commercial goods, and that the Rogers test (which protects free speech in creative works) was misapplied. Viktor Johansson, European Trademark Attorney & CEO of Digip, weighs in: "This case is a defining moment for IP law in the digital age. The outcome could shape how brands enforce trademarks against virtual goods and influence legal strategies for protecting digital assets. Companies must prepare for evolving challenges in trademark enforcement as the digital economy expands." What’s your take? Should NFTs be protected as free artistic expression, or do brands have the right to enforce trademarks in the digital economy?
