A winding up order doesn’t always have to be final. If your client was not properly served, or the order was made in their absence, they may apply to have it set aside or terminated under Court rules. Section 482 of the Corporations Act allows for termination or a stay of the order, but only if the underlying issues (such as solvency, notice, creditor agreement) are resolved. Timing matters a lot. Acting quickly could restore control, limit losses, and protect the company’s position and reputation. #SetAsideOrder #WindingUpChallenge #CorporationsAct #DirectorRights #LegalOptions #InsolvencyAwareness #SmallBusinessHelp

Our final birthday celebration of the year at the Loganholme office 🎉 Bella, Hank and Darren might not be giving full “birthday energy” in the photo… but trust us, spirits (and sugar levels) were high. After years of hearing Darren rave about the same tiramisu cake he gets every birthday at home, we finally cracked the code and bought it for the office. He’s now had it twice this week, and the rest of us finally understand the hype. Happy birthday to our superstars! 🎂😁 Hank de Jonge Darren Addison Bella Harrison

The ATO plays more than an observer role in winding up processes. When statutory demands for tax debts go unpaid, the ATO can escalate, issuing the demand, then applying to court for winding up. For many debtors, that becomes the turning point. Before winding up, the ATO will usually try recovery options, payment plans or other compliance tools. But once they proceed, the company’s in court ordered territory. Helping clients stay ahead of ATO demands and understand their exposure can prevent forced winding up.

When a winding up order is made, the fallout for your client can be deeper than just loss of business. Directors lose control immediately, the liquidator steps in. If there’s been trading while insolvent, or decisions made carelessly, those past actions will come under scrutiny. Personal liability isn’t just a risk, it can become reality. Also expect public exposure: once proceedings become visible, lenders, suppliers, employees all respond. Helping your clients understand these risks early often changes their exit choices. #DirectorRisk #WindingUpOrder #InsolvencyAwareness #LegalLiability #BusinessProtection #SmallBusinessAdvice
