𝐒𝐨𝐦𝐞𝐭𝐢𝐦𝐞𝐬 𝐭𝐡𝐞 𝐬𝐢𝐠𝐧𝐚𝐥 𝐢𝐬 𝐡𝐢𝐝𝐢𝐧𝐠 𝐢𝐧 𝐩𝐥𝐚𝐢𝐧 𝐬𝐢𝐠𝐡𝐭. Take this example from our founder, Mohammed Rashik, speaking on the Law, disrupted podcast: A food label says “preservative-free” but lists citric acid in the ingredients. On its own, that detail might seem harmless. Now connect three pieces of data: 1. FDA guidance stating citric acid is a preservative 2. Existing class actions over the same fact pattern 3. The brand’s own label making the “preservative-free” claim Put them together, and you have a clear early-warning sign of litigation risk. This is the core of what Rain Intelligence delivers: 💧 We merge data sources that rarely speak to each other 💧 We surface non-obvious signals that point to potential liability 💧 We deliver them to attorneys before the case is filed In litigation, timing is everything. The right insight at the right moment can mean the difference between leading a case and reading about it in the news. 🎧 Listen to the full conversation: Spotify: https://lnkd.in/eYS7amcz Apple: https://lnkd.in/ex28Zfwi Website: https://lnkd.in/ezH8uQ6h

Rain’s new Product Safety & Packaging Claims report tracks how product problems become litigation, and where similar claims could surface next. Explore the report: https://lnkd.in/ex5MrZYi A closure that fails. Contamination discovered after distribution. A dosage claim that testing calls into question. Each gives plaintiffs a different starting point. The resulting claims can reach manufacturers, private-label brands and retailers, depending on their role in the product and the representations made about it. The report brings filed matters, investigations and forecasts together across food, healthcare, personal care, household goods and children’s products. The value is in seeing the connections: which allegations recur, which firms pursue them, and which businesses could face a similar complaint. #ProductLiability #ClassActions #ConsumerProtection #FalseAdvertising #FoodAndDrugLaw

Rain’s new report follows pricing-software litigation into the businesses buying the software. Landlords. Hotel operators. Health insurers. Fuel retailers. Across these markets, plaintiffs are asking what happens when competitors feed confidential information into a shared service and receive pricing recommendations in return. Explore the Antitrust Pricing Tools & Algorithms report: https://lnkd.in/emAhp8A4 The healthcare cases make the point particularly well. Providers allege that insurers used a common repricing service to suppress what they paid for medical care. The alleged injury comes from prices being pushed down. That broadens the question beyond which companies might be overcharging their customers. It also puts purchasing decisions, vendor contracts and data-sharing arrangements into the litigation story. Using the same software is not enough to establish a conspiracy; what the participants agreed to do with it matters. Rain brings together filed matters, investigations and forecasts so readers can follow that argument across industries and assess where it could surface next. #AntitrustLitigation #ClassActions #CompetitionLaw #TechnologyLaw #CommercialLitigation

𝐑𝐚𝐢𝐧’𝐬 𝐧𝐞𝐰 𝐫𝐞𝐩𝐨𝐫𝐭 𝐭𝐫𝐚𝐜𝐤𝐬 𝐚 𝐜𝐥𝐚𝐬𝐬-𝐚𝐜𝐭𝐢𝐨𝐧 𝐭𝐡𝐞𝐨𝐫𝐲 𝐭𝐡𝐚𝐭 𝐜𝐚𝐧 𝐨𝐟𝐭𝐞𝐧 𝐛𝐞 𝐬𝐩𝐨𝐭𝐭𝐞𝐝 𝐟𝐫𝐨𝐦 𝐭𝐰𝐨 𝐥𝐢𝐧𝐞𝐬 𝐨𝐧 𝐚 𝐟𝐨𝐨𝐝 𝐩𝐚𝐜𝐤𝐚𝐠𝐞: Front label: “Zero Sugar.” Ingredient list: allulose. Read the report: https://lnkd.in/eiDCdkzr FDA guidance allows manufacturers to leave allulose out of the “Total Sugars” and “Added Sugars” figures in the Nutrition Facts panel. But the underlying regulation still defines allulose as a sugar. That distinction became actionable in July, when the Seventh Circuit revived Franco v. Chobani. The court held that FDA’s decision not to enforce the sugar-declaration requirements did not rewrite the regulation or preempt state-law claims challenging Chobani’s “Zero Sugar” representation. The ruling established no liability. It gave the plaintiffs’ theory another day in court. It also made the theory easy to carry from one grocery aisle to another. Recent complaints have challenged allulose claims on yogurt, electrolyte powder, energy drinks, cereal and snack bars. Some now target “Zero Added Sugar,” an extension that Franco did not resolve. Rain’s report maps 14 filed cases and 63 additional defendants forecasted to face litigation. The question is no longer confined to what appears inside the Nutrition Facts box. It is what the rest of the package promises. #FoodLaw #ClassActionLitigation #FalseAdvertising #FDARegulation #ConsumerProtection #Zerosugar #Allulose

Rain’s new Auto-Renewal & Subscription Trap report looks at where subscription litigation could go next, and which companies may need advice before a complaint arrives. Take a business that converts free trials into paid subscriptions. A lawsuit challenging another company’s enrollment process could give its lawyers a reason to look more closely at how it obtains consent. The useful conversation starts there: here’s the practice being challenged, here’s where your business may be doing something similar, and here’s what deserves a closer look. The report brings together filed cases, investigations and Rain’s forecasts to help identify those connections.
