What iGaming and Fintech Companies Need to Get Right From Day One A license is the foundation your entire business operates on. Losing it in iGaming or Fintech is rarely a recoverable situation: the process is lengthy, reputationally damaging, and in many cases simply does not end in restoration. The more practical question is how to ensure you never get there 1. Keep Your KYC and AML Procedures Current Most of the regulators have significantly raised the bar on compliance in 2025-2026, particularly around ongoing transaction monitoring, not just initial client onboarding. Outdated procedures are one of the most common reasons companies attract regulatory scrutiny in the first place Recommendation: Review your KYC and AML framework regularly - not only when something goes wrong, but as a scheduled part of your compliance calendar 2. Take Reporting Seriously Delayed or incomplete reporting, particularly SAR submissions and transactional reports is a frequent trigger for formal regulatory investigations. Once an investigation is opened, the dynamic with your regulator changes significantly Recommendation: Automate reporting where possible and establish clear internal deadlines. Regulators notice patterns, and consistent accuracy builds trust over time 3. Maintain Proactive Communication with Your Regulator Companies that engage openly with their regulator, including voluntary disclosure of identified issues, consistently receive more favorable treatment than those where problems are discovered externally. Silence is rarely interpreted as a good sign Recommendation: Treat your regulator as a long-term stakeholder. Regular dialogue and early disclosure of potential issues can make a meaningful difference when it matters most. 4. Ensure Your Substance Is Genuine Jurisdictions such as Malta and Gibraltar require real local presence instead of just a registered address. A company managed entirely from another country risks license suspension on substance grounds alone, regardless of its compliance record Recommendation: Ensure your local structure reflects actual operational activity: local management involvement, documented decision-making, and appropriate staffing on the ground License revocation is rarely sudden. It is almost always the result of issues that accumulated gradually and were not addressed in time. A consistent, proactive approach to compliance is what protects the business you have built. If you would like to review your current compliance framework or assess potential licensing risks, Key2Law is available to help
